What Is an AI Likeness?

An AI likeness is any AI-generated visual, auditory, or behavioral representation that is recognizably derived from a specific, identifiable real person. The term encompasses a broad spectrum of synthetic outputs — from a single AI-generated image of a person, to a voice clone that replicates their speech, to a fully autonomous AI digital twin that combines visual, vocal, and behavioral replication. The unifying characteristic is recognizability: if an audience can identify the real person from the AI-generated output, that output constitutes an AI likeness.

The concept of AI likeness extends the traditional legal concept of “likeness” (as used in right of publicity law) into the generative AI domain. Traditional likeness refers to a person’s physical appearance as captured in photographs or video. AI likeness refers to synthetic representations generated by AI systems that were trained on a person’s biometric data.

AI likeness is becoming a central concept in the legal frameworks governing the AI identity economy. The critical legal question is: who controls the right to generate an AI likeness of a specific person? Under existing right of publicity statutes, individuals generally have the right to control commercial use of their likeness. The deal’s structure — granting exclusive 36-month rights to create and deploy an AI likeness for commercial purposes — provides an early contractual template for AI likeness licensing.

Commercial Value

The commercial value of an AI likeness is determined by several factors: the recognizability and audience reach of the original person, the quality and fidelity of the AI replication, the breadth of authorized use cases, and the geographic and temporal scope of the license. For high-profile creators and public figures, AI likeness rights represent a potentially transformative revenue stream — enabling monetization at a scale and in markets that physical presence alone could never achieve.
