This capability raises ethical questions that neither technology companies, lawmakers, nor society at large have fully resolved. The questions are not abstract. They affect the 50 million active content creators whose identities are now commercially deployable assets, the billions of individuals whose faces and voices could be replicated without their knowledge, and the societies grappling with the erosion of shared trust in media authenticity.

The $975 million Khaby Lame transaction put a price on these questions. When a human identity becomes a tradeable, deployable, revenue-generating asset, the ethical framework governing its creation, ownership, and use becomes a matter of immediate commercial consequence — not just philosophical debate.

This analysis examines the core ethical dimensions of AI cloning: the consent problem, the ownership question, the special cases of posthumous and non-consensual cloning, and the frameworks being proposed to govern a technology that has outpaced the ethical infrastructure designed to contain it.

Consent is the foundational ethical requirement for AI cloning. Without meaningful consent, creating an AI replica of another person is an act of identity appropriation. But what constitutes meaningful consent in this context is far more complex than a checkbox on a terms-of-service page.

Ethical consent for AI cloning must be specific, informed, revocable, and compensated.

A person must have the ability to end the use of their identity, even if the technical implementation requires alternative mechanisms such as usage restrictions and model decommissioning rather than literal data deletion.

Compensated means that when identity cloning generates commercial value, the identity owner participates in that value. The ethical objection is not to AI cloning per se — it is to AI cloning that extracts value from an individual’s identity without proportional return.

The Terms-of-Service Problem

The practical reality falls far short of these ethical standards. When a user uploads their face and voice to an AI avatar platform like HeyGen, Synthesia, or D-ID, they typically agree to terms of service that grant the platform broad rights to use the data for model improvement and service delivery. The consent is neither specific (it covers broad categories of use), nor informed (few users read or understand the implications of the terms), nor meaningfully revocable (data deletion does not reverse model training).

This does not mean these platforms are acting unethically — they are operating within legal norms. But it means the current standard for consent in AI identity is far below what an ethical framework demands. The gap between legal compliance and ethical adequacy is where the most significant work needs to happen.

The Third-Party Problem

A distinct ethical challenge arises when AI cloning technology is used to replicate individuals who have no relationship with the platform. Current generation technology can create a plausible AI clone from publicly available video and audio — a TikTok interview, a YouTube video, a podcast episode. Detection technology lags behind generation, and legal remedies are slow and jurisdiction-dependent.

The Ownership Question

If consent establishes the ethical permission to create an AI clone, ownership determines who controls it after creation. This question has both ethical and economic dimensions that are frequently in tension.

The Ethical Case for Identity Sovereignty

The concept of biometric sovereignty — the principle that individuals should have ultimate control over their biometric data and any AI models derived from it — represents the strongest ethical position on ownership. This argument has some merit but breaks down at the boundary. A photograph captures a moment. An AI clone captures an identity — the capacity to generate unlimited new content that bears the subject’s likeness, speaks in their voice, and represents their persona. The scope of the creation is categorically different.

The Khaby Lame Case Study

The Khaby Lame deal illustrates the ownership complexity. Khaby Lame authorized the creation of an AI twin as part of a $975 million transaction. But the operational control of that twin rests with Rich Sparkle Holdings and the Three Sheep Group — entities that Khaby does not manage. The twin’s commercial activities, brand associations, and content output are controlled by these partners, not by the person whose identity it replicates.

This raises ethical questions that the deal’s financial structure does not resolve. If the AI twin makes statements or associations that damage Khaby Lame’s personal brand, whose responsibility is that? If the twin is deployed in a market context that Khaby would not have chosen, does his authorization of the technology constitute authorization of every use? If the deal terms expire but the AI model continues to exist, what happens to the digital identity?

Posthumous AI Cloning

The creation of AI replicas of deceased individuals represents one of the most ethically complex applications of the technology.

The Cases For

Proponents of posthumous AI cloning cite several ethical justifications. Cultural preservation: AI replicas of historical and cultural figures can serve educational purposes, making history more accessible and engaging. Legacy continuation: creators and artists may wish their work to continue after their death, and AI clones could fulfill this intention. Comfort: family members may find meaning in AI representations of deceased loved ones, similar to how photographs and recordings preserve memories.

The Cases Against

The ethical objections are substantial. Consent impossibility: a deceased person cannot provide informed consent to AI cloning, and any prior consent cannot anticipate the full range of potential uses. Misrepresentation risk: an AI clone may generate content that the deceased person would have objected to, with no mechanism for correction. Commercial exploitation: posthumous AI cloning can be motivated by financial extraction from a deceased person’s identity without their ability to negotiate or refuse. Dignity concerns: there is a fundamental question about whether creating a speaking, acting synthetic replica of a deceased person respects their dignity, regardless of intent.

Several jurisdictions are addressing posthumous AI cloning through legislation. California’s AB 1836 extends personality rights protection posthumously. The proposed federal NO FAKES Act includes a 70-year posthumous protection period. Tennessee’s ELVIS Act explicitly covers deceased individuals. These laws attempt to create a framework where posthumous cloning is possible under controlled conditions — typically with estate authorization — while preventing unauthorized exploitation.

The scale of the problem is significant. Research indicates that non-consensual intimate deepfakes account for a substantial portion of all deepfake content online. The barrier to creation has dropped to near zero — mobile applications and free online tools can generate explicit deepfakes from a single social media photograph.

The ethical consensus against this application is essentially universal. The challenge is enforcement. Creation occurs privately and globally. Distribution happens on platforms with limited moderation. Victims often discover the content long after it has been widely shared. Legal remedies are slow and jurisdiction-dependent, and many victims choose not to pursue them due to the additional public exposure involved in legal proceedings.

The ethical challenges of AI cloning are not going to be resolved by any single mechanism — not by technology alone, not by law alone, and not by industry self-regulation alone. An effective framework requires all three.

Technical Layer

Platforms building AI cloning technology have an ethical obligation to implement consent verification that ensures genuine informed consent before any identity replication, watermarking and provenance tracking that makes every AI-generated piece of content traceable to its source, detection capabilities that enable identification of unauthorized clones, and access controls that prevent the technology from being used to clone individuals without authorization.

Legislation must establish clear personality rights that extend to AI replications in all jurisdictions, criminal penalties for non-consensual AI cloning with particular severity for intimate content, regulatory standards for consent, disclosure, and data protection in commercial AI cloning, and international cooperation mechanisms because AI cloning does not respect jurisdictional boundaries.

Industry Layer

The AI cloning industry must adopt standards that go beyond legal minimums. This includes ethical review processes for high-risk applications, transparency about capabilities and limitations, investment in safety research and detection technology, and participation in standards bodies like C2PA that build trust infrastructure.

Individual Layer

Individuals must understand that their biometric data has commercial value and requires protection. This includes being deliberate about which platforms receive your biometric data, reading and understanding the terms under which your data will be used, taking advantage of identity vaulting and sovereignty tools as they become available, and monitoring for unauthorized use of your identity through detection services.

The ethics of AI cloning will not be settled definitively. The technology will continue to advance, creating new capabilities and new risks that existing frameworks cannot fully anticipate. What can be established is a set of principles — consent, ownership, transparency, accountability, and sovereignty — that guide decision-making as the technology evolves. The creators, platforms, and institutions that anchor their practices in these principles will build more durable, more trustworthy, and ultimately more valuable positions in the AI identity economy.
